    VA Overpayment / Debt Waiver

When the VA pays a veteran more than they are entitled to receive (often due to rating reductions, dependent changes, or administrative errors), the VA issues a debt notice -- veterans have rights to dispute, waive, or repay the debt.

Veterans have 30 days from notice to request a waiver, compromise, repayment plan, or dispute.

Waiver: the VA can forgive the debt if repayment would cause financial hardship and the overpayment was not the veteran's fault.

Compromise: you offer a lump sum less than the full amount in settlement.

Hardship repayment plan: the VA can spread repayment over up to 5 years or longer with justification.

-> Contact the VA Debt Management Center (DMC) at 1-800-827-0648 immediately upon receiving an overpayment notice.

Frequently asked questions about VA Overpayment / Debt Waiver

What is a VA overpayment or debt waiver?+

Sometimes the VA pays a veteran more money than they should have. This might happen if your disability rating changes or if there are errors. When this happens, the VA will send you a letter about the debt. You have rights to question this debt, ask for it to be removed, or set up a repayment plan.

Who can get a VA debt waiver?+

If you receive a debt notice from the VA because of an overpayment, you can ask for a waiver. This means you are asking the VA to cancel the debt. Common reasons for overpayment include changes in your disability rating, adding or removing dependents, or mistakes made by the VA.

How do I ask for a VA debt waiver?+

When you get a debt letter from the VA, it will tell you how to ask for a waiver. You usually have a certain amount of time to respond. You will need to explain why you think you should not have to pay the money back. The VA will look at your situation and make a decision.

What happens if my VA debt waiver is approved?+

If your VA debt waiver is approved, you will not have to pay back the money the VA says you owe. This can bring you peace of mind and help you avoid financial stress. If you are denied, you still have options to appeal the decision or work out a payment plan.
